Commercially Pty Ltd, ACN 133 025 635 (“Commercially”, “we”, “us” or “our”) is committed to protecting personal information we collect from you. We have implemented measures to comply with our obligations under the Privacy Act 1988 (Cth) (“Privacy Act”) and the Australian Privacy Policies set out in the Privacy Act.

This Privacy Policy outlines our practices for managing your personal information that we collect when you use any of our websites (www.commercially.com.au, www.agent.commercially.com.au, and www.premier.commercially.com.au) (“Websites”). Commercially values your privacy. The purpose of this Privacy Policy is to enable you to make an informed decision when releasing personal information. This Privacy Policy is incorporated into and subject to the Commercially Terms of Use.

In summary, ‘personal information’ is information or an opinion relating to an individual which can be used to identify that individual.

Why does Commercially collect personal information?

We collect your personal information in order to provide and market our Websites and services to you and to meet our legal obligations. Your granting of any consent and your provision of any personal information is entirely voluntary, however your personal information is required for many services we provide on our Websites. What personal information does Commercially collect?

The type of information we may collect and hold includes the name, email address, phone number, residential address, and occupation of registered members and potential members, and of real estate agencies and their employees.

What if you don’t provide Commercially with your personal information?

We note that if personal information we request is not provided, we may not be able to supply the relevant product or service to you. Please note that we do not collect any personal information we do not need to provide our services.

How does Commercially collect and store your personal information?

We generally collect personal information from:

  • information you give in face-to-face meetings or interviews;
  • business cards that you give to us;
  • any communications with us, including telephone conversations;
  • your engagement with us via social media; and
  • information given by third parties, such as marketing information and credit reports.

    How might Commercially use and disclose your personal information?

    We may use and disclose your personal information for the primary purpose for which it is collected, for reasonably expected secondary purposes, which are related to the primary purpose, and in other circumstances authorised by law.

    To whom might Commercially disclose your personal information?

    We may disclose your personal information to:

    • third party companies or individuals who assist us in providing services or who perform functions on our behalf (such as our mailing house);
    • third parties located outside Australia, where it relates to the purpose for which the information was originally collected, is required to maintain our records and website, or for the administration of any of our processes and processing of payment; and

    What about linked third party websites?

    Our Websites may contain links to third party websites not associated with Commercially. We do not share personal information with those websites and are not responsible for their privacy practices. We make no warranty as to the accuracy or content of those linked websites, or that such links will be maintained and current.

    Management of personal information

    We take reasonable steps to keep personal information secure and to protect personal information we hold from misuse, loss, unauthorised access, modification, destruction or disclosure, for example by use of physical security and restricted access to electronic records. We only permit our authorised personnel to access your personal information, and our personnel are required to respect the confidentiality of personal information and your privacy. Where we no longer require your personal information for a lawful purpose, we will take reasonable steps to destroy it.

    We want to ensure that you make payments with complete confidence online. When making payments through our Website, your financial details, including credit card number, are passed through a secure server using the latest Hypertext Transfer Protocol Secure (HTTPS) encryption technology. HTTPS is the industry-standard and helps protect your personal details online.

    How does Commercially keep personal information accurate and up-to-date?

    We endeavour to ensure that the personal information we hold is accurate, complete and up-to-date. We encourage you to contact us in order to update any personal information we hold about you. If any of the information that you provide to us when you register as a member changes, you can update the information yourself via the Commercially Websites or by contacting us on the email set out below.

    You have the ability to gain access to your personal information

    Subject to the exceptions set out in the Privacy Act, you may gain access to the personal information which we hold about you by contacting help@commercially.com.au.

    We will require you to verify your identity and to specify what information you require. A fee may be charged for providing access to cover our reasonable administrative costs. We will advise you of the likely cost in advance.

    What about non-personal information?

    We may collect and use browser related information, IP addresses, requested URL’s, referring URL’s and timestamp data. We use this information to maintain the Commercially Websites and provide the Commercially services. We may also use this information to perform statistical analyses and inform advertisers of such information.

    Children’s privacy

    Children under 18 years of age are not permitted to use our Websites or our services or to register as a member. We do not collect personal information about children under 18 years of age. If we become aware that a child under 18 years of age is accessing our Websites or services, we will contact the child only to inform that he or she is not permitted to access the Websites or use our services.

    Merger, sale or insolvency

    If Commercially is to be acquired by or merge with another entity we may transfer or assign the information we have collected about Website users as part of the acquisition, sale, merger or change of control. We may not be able to control how personal information collected is used in the event of insolvency, receivership or assignment for the benefit of creditors.
